Microsoft Cashback Use Terms

Effective: December 14, 2022


Thank you for participating in the Microsoft Cashback (formerly, Bing Rebates) program!

Under Microsoft Cashback, you may be eligible to receive a cashback from Microsoft when you sign up for Microsoft Cashback and visit a participating merchant's website from a link, browser, search box, module, or website on which Microsoft Cashback is activated, and make a purchase from that merchant. In addition, if you link an eligible credit or debit card to your Microsoft Cashback account, you may be eligible to receive a cashback from Microsoft when you use your credit or debit card to make qualifying purchases in store at participating merchants. The maximum aggregate amount that you will be eligible to receive from Microsoft as part of the cashback program is $1,000 U.S. dollars per year (or the local currency equivalent). If you are eligible to receive a cashback, once the merchant or Microsoft validates your purchase and after a waiting period has elapsed, Microsoft will credit your cashback to your Microsoft Cashback account, in accordance with the terms set forth below.

Introduction

The terms and conditions set out in this document ("Terms") will apply to your participation in the Microsoft Cashback program and the services that Microsoft provides you in connection with the program, including creating your Microsoft Cashback account and crediting your account to reflect eligible purchases that you make in the circumstances described in these Terms ("Services"). The Services are provided by the Microsoft entity in your location. “Microsoft” means Microsoft Online, Inc. (6880 Sierra Center Parkway, Reno, NV 89511 USA) in the United States. “Microsoft” means Microsoft Corporation (India) Private Limited (Level 10, Tower C, Epitome, Building No. 5, DLF Cyber City, Phase 3, Gurugram 122002 – Haryana, India) in India. “Microsoft” means Microsoft do Brasil Importação e Comércio de Software e Video Games Ltda., enrolled with the CNPJ under No. 04.712.500/0001-07 (Av. Presidente Juscelino Kubitscheck 1909, Torre Sul, 18 Andar, conj. 181 – Vila Nova Conceição, CEP: 04543-907 São Paulo/SP Brasil) in Brazil. “Microsoft” means Microsoft Ireland Operations Limited (One Microsoft Place, South County Business Park, Leopardstown, Dublin, Ireland 18, D18 P521) in Europe, the Middle East, or Africa (“EMEA”) or Asia-Pacific (“APAC”). By registering for the Microsoft Cashback program, you agree to be bound by these Terms.

If you are a consumer in the EU or the UK you will have a legal right to withdraw from these Terms within 14 days of your contract with use under these Terms being made. You can withdraw this, or terminate these Terms at any time, by closing your Microsoft account or opting-out of Microsoft Rewards and no longer accessing and using the Services.

If you are a consumer living in the EU or UK, you will have certain mandatory consumer rights. If you are a consumer living elsewhere, you may also have consumer rights under the laws of your territory. Nothing in these Terms affects your mandatory consumer rights. For consumers resident in the UK and the EU, nothing in these Terms will limit or exclude Microsoft's liability for death or personal injury caused by negligence, nor fraud or fraudulent misrepresentation arising from Microsoft's negligence.

The term "you", "yours", and similar terms refers to the individual who has created a Microsoft Cashback account and uses the Services and/or participates in the program.

Microsoft Cashback is part of the Microsoft Rewards program. Microsoft Cashback may collect product information, cart, and transaction details from the sites you shop at with Microsoft Edge. This is collected for the purposes of providing you with cash back. Your participation in the Microsoft Cashback program is also subject to the terms of the Microsoft Services Agreement, and the Microsoft Privacy Statement. In the event of any conflict between these Terms and the terms of the Microsoft Services Agreement, these Terms prevail.

Eligibility for Microsoft Cashback 

To participate in Microsoft Cashback, you must:  

  • Be at least 18 years of age and a lawful resident of the United States (50 states and Washington, D.C. only), United Kingdom, European Union, or Japan. 
  • Have a Microsoft account. Click here to learn more about Microsoft accounts. If you don't have a Microsoft account, you can create one. 
  • Register for the Microsoft Cashback program.
  • Have an account with PayPal. For more information about PayPal, click here
  • Have cookies enabled on your browser, so we can track your purchases and credit the associated cashback to your Microsoft Cashback account.  

Additionally, you are ineligible to participate in Microsoft Cashback if Microsoft is prohibited from allowing you to participate in Microsoft Cashback under applicable law. 

If you are a consumer resident in the EU or the UK, we may deny you access to the Services if we reasonably consider that you do not meet the above eligibility criteria, if you violate these Terms or for other reasonable cause (including if we reasonably consider your participation in the Microsoft Cashback program or our provision of the Services breaches applicable law). If you are a consumer resident outside of the UK or the EU, we reserve the sole right to determine your eligibility to participate in Microsoft Cashback. 

If at any time we suspect (or, if you are a consumer resident in the UK or EU, reasonably suspect) that you have provided false information or are engaging in fraudulent activities or activities that violate these Terms or the terms of the Microsoft Services Agreement, we may suspend or terminate your Microsoft Cashback account and disallow payouts.

You cannot earn cash back unless you have signed up for a Microsoft account and registered with it for the Microsoft Cashback program.

If you have activated an offer and completed a qualifying purchase without creating a Microsoft account and registering for the Microsoft Cashback program, you are not eligible to earn Cashback. You must create a Microsoft account and register for the Microsoft Cashback program from the cash back notice for your purchase within 30 days in order to earn the cash back.

Signing up for Microsoft Cashback 

When you sign up for Microsoft Cashback, we will request certain registration information from you, including your Microsoft account email address, your full name, your date of birth, and other personal information, to create a Microsoft Cashback account. We use this information to check your eligibility to participate, and to make sure that the cashback you earn is correctly credited to your Microsoft Cashback account, and to send you communications about the program. Linking credit or debit cards

If you link an eligible credit or debit card to your Microsoft Cashback account, you can earn additional cashback rewards when you use your linked credit or debit card (Visa, Mastercard or American Express only) to make qualifying purchases in store at participating local merchants. When you link your credit or debit card to your Microsoft Cashback account, you authorize the Payment Card Network (Visa, Mastercard or American Express) to securely share transaction information with Microsoft’s third party service providers (such as Figg, Inc.) in accordance with PCI DSS standards and as described in “Sharing data with merchants and third parties – card-linked offers” section below.

When you first input your credit or debit card number for card-linked offers, Microsoft will pass your credit or debit card number to its third party service provider to enroll your card. Microsoft does not retain a full copy of your credit or debit card number but just stores the last 4 digits of your credit or debit card number for verification purposes only. You may optionally choose to have Microsoft store your full credit or debit card number to use that card for payments made with your Microsoft Account, but it is not required for the card-linked offers.

Double Enrollment Restrictions

We use Figg, Inc. as our service provider to help us operate our program. Your payment card may only be enrolled in one program operated by Figg, Inc. If you have already enrolled a payment card with a separate program operated by Figg, Inc., you will be unable to register that card in the Microsoft Cashback program.

Eligible purchases

Cashback offers may vary across store/products/categories and exclusions may apply. Please review each merchant's details page on the Microsoft Cashback dashboard to see which products are and are not eligible for cashback. Gift certificate and gift card purchases are not eligible for Microsoft Cashback. Most merchants disallow cashback on purchases that use coupon codes, so if you use a coupon code, you should not expect to earn a cashback. The cashback amount for which you are eligible is based on the net purchase amount, excluding taxes, fees, shipping, gift-wrapping, warranties, discounts or credits, returns or cancellations. For some personalized offers that Microsoft may present to you, Microsoft will verify the purchase eligibility before confirming the cashback. Purchases that are returned or canceled are not eligible for cashback. 

When making a purchase using a linked debit card in store, you must choose “credit” during your purchase and must not use your PIN. If you use your debit card in “debit” mode using your PIN, your transaction cannot be eligible and you will not be eligible for a cashback in relation to your purchase.

There are several scenarios in which you may not receive credit for purchases, see our FAQs for more information.  In some cases, if you click from Microsoft Cashback to a merchant, then from another site or tool to the merchant, the merchant may recognize that other site or tool as the referral leading to your purchase—and the merchant will advise us that your purchase is not eligible for a Microsoft Cashback. Similarly, adware, malware, shopping tools or browser extensions may affect purchase tracking. For most reliable tracking, click from Microsoft Cashback to the merchant, then immediately make a purchase, without clicking to any other site in between.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE ARE NOT RESPONSIBLE FOR OR LIABLE TO YOU IN THE EVENT THAT THE MERCHANT DOES NOT CREDIT MICROSOFT AS THE SOURCE OF THE PURCHASE OR IN THE EVENT THAT MICROSOFT IS NOT ABLE TO VERIFY ELIGIBILITY OF THE PURCHASES. YOU COULD EARN A CASHBACK THROUGH MICROSOFT CASHBACK WHILE ALSO EARNING POINTS FROM A CREDIT CARD PROGRAM. HOWEVER, YOU WILL NOT RECEIVE ANY CASHBACK FROM MICROSOFT CASHBACK IF YOU RECEIVE CASHBACK OR POINTS FROM A THIRD PARTY FOR THE SAME PURCHASE. YOU CAN RECEIVE UP TO AN AGGREGATE MAXIMUM AMOUNT OF $1,000 USD PER YEAR (OR THE LOCAL CURRENCY EQUIVALENT) IN CASHBACK ACROSS ALL MERCHANTS, INCLUDING ONLINE AND INSTORE MERCHANTS. FOR IN-STORE CASHBACK THROUGH LINKED CREDIT OR DEBIT CARDS, YOU CAN RECEIVE A MAXIMUM CASHBACK OF $250 USD PER SPECIFIC TRANSACTION (OR THE LOCAL CURRENCY EQUIVALENT). 

The cashback amount for which you are eligible is calculated based on the information we receive from the merchant. We can only pay you a cashback if the merchant reports your purchase to us and agrees that your purchase is eligible for a cashback.   

Your purchases from a merchant are subject to the merchant's terms and conditions and policies.  You should review those policies prior to making any purchases.  Any issues you have with a product, service, transaction or merchant must be directed to the merchant, and Microsoft is not liable or responsible for the transaction between you and the merchant or for any products or services you purchase.

Payments 

Cashback will be credited to your Microsoft Cashback account after a waiting period determined by Microsoft in its sole discretion (or, if you are a consumer resident in the UK or the EU, in Microsoft's reasonable discretion). Typical waiting period for cashback is up to 90 days after purchase, for non-travel purchases. For travel purchases, the waiting period is 90 days after your travel is complete. Travel not completed prior to the termination of the Microsoft Cashback program will not be eligible for any rebates.

Your cashback account page will report the date at which we expect a cashback to become available. If the merchant indicates to us that your order has been fully or partially canceled, returned or otherwise voided (even after the waiting period has passed), we reserve the right to adjust your cashback account accordingly (if you are a consumer resident in the UK or the EU, in our reasonable discretion). You can dispute any issues with support by opening a ticket. In addition, if we believe there is any fraudulent or abusive use of the Microsoft Cashback program, we reserve the right to suspend your cashback payment while we investigate such behavior. 

After the waiting period, Microsoft will credit the cashback to your account.  YOU MAY TRANSFER YOUR EARNED CASHBACK TO PAYPAL AFTER IT BECOMES AVAILABLE. THERE ARE NO OTHER METHODS OF PAYMENT AT THIS TIME. IF YOU DO NOT HAVE AN ACCOUNT WITH PAYPAL, MICROSOFT IS NOT OBLIGED TO PROVIDE YOU WITH YOUR CASHBACK THROUGH ANY OTHER PAYMENT MEANS. To sign up with PayPal, click here. Prior to sending you your payment, your financial services provider may request further information to verify your identity. Microsoft will not send you a payment if Microsoft is prohibited from doing so under applicable law (including sanctions or export control regulations).

You are responsible for any taxes and charges you may incur as a result of our payment of cashback to you. To the maximum extent permitted by applicable law, Microsoft is not liable or responsible for your problems accessing PayPal or withdrawing funds.

Account maintenance fees

If you (i) do not transfer your earned cashback to PayPal within 6 months, starting from the period of time when Microsoft credits the cashback, after they become available for transfer, and (ii) have not earned additional cashback within the same six month period, we will deduct from your Microsoft Cashback account, on a monthly basis, the lesser of (i) $5.00 USD (or local currency equivalent), or (ii) the amount remaining in your Microsoft Cashback account (in either case, an “Account Maintenance Fee”). The Account Maintenance Fee is to cover the cost associated with maintenance and administration of your Microsoft Cashback account. Microsoft will keep charging the Account Maintenance fee until you earn additional cashback, or you transfer your available cashback to PayPal. No Account Maintenance Fee will be charged or deducted during the first 6 months after you initially create a Microsoft Cashback account. If you have no available cashback amounts in your Microsoft Cashback account, you will not be charged an Account Maintenance Fee, and under no circumstances will you be asked to pay an Account Maintenance Fee with anything other than amounts in your Microsoft Cashback account. For the avoidance of doubt, if you retain earned cashback in your Microsoft account and continue to earn additional cashback, you will not be required to pay any account maintenance fees.

Eligible credit and debit cards

Not all Visa, MasterCard, and American Express cards are eligible for registration. Visa, MasterCard, and American Express Corporate cards, Visa, MasterCard, and American Express Purchasing cards, non-reloadable prepaid cards, government-administered prepaid cards (including EBT cards), healthcare (including Health Savings Account (HSA) or Flexible Spending Account (FSA) or insurance prepaid cards, Visa Buxx, and Visa-, MasterCard-, and American Express-branded cards whose transactions are not processed through the approved payment system, MasterCard payment system, and/or American Express payment system are not eligible to participate.

Card linked transaction eligibility

Not all transactions with your registered Visa, MasterCard and American Express card are tracked by Visa, MasterCard and American Express.

You acknowledge that Visa, MasterCard, and American Express may be unable to monitor every transaction made with your enrolled Visa, MasterCard, or American Express card, including PIN-based purchases, purchases you initiate through identification technology that substitutes for a PIN, payments made through other payment methods (such as a digital wallet or a third party payment app, where you may choose your Visa, MasterCard, or American Express card as a funding source but you do not present your card directly to the merchant), payments of existing balances, balance transfers, or transactions that are not processed or submitted through the Visa U.S.A., MasterCard, and American Express payment systems, and that these transactions are not eligible.

Privacy

Sharing data with merchants and third parties - online shopping

Your participation in Microsoft Cashback is subject to the Microsoft Privacy Statement. In addition to the uses described in the Privacy Statement, when you make purchases online, we may share your information with merchants and our business partners in the Microsoft Cashback program to:

  • Use transaction data to confirm a qualifying purchase or return to match transactions to confirm whether you qualify for cashback;
  • Share transaction data with the participating merchant where a transaction occurred as needed for the merchant to confirm a specific transaction occurred;
  • Create a record of the transaction data and thereafter maintain and use data in connection with operating the Microsoft Cashback program (including customer support and fraud analysis);
  • Target offers that may be of interest to you and enable further personalized offers based on your purchase history; and
  • Conduct analysis for the improvement and optimization of the Microsoft Cashback program.

BY PARTICIPATING IN MICROSOFT CASHBACK, YOU AUTHORIZE THE SHARING, EXCHANGE AND USE OF TRANSACTION DATA DESCRIBED ABOVE AND HEREIN BY AND AMONG MICROSOFT, OUR BUSINESS PARTNERS AND APPLICABLE MERCHANTS. YOU MAY OPT OUT OF THE SHARING OF SUCH INFORMATION BY TERMINATING YOUR PARTICIPATION IN MICROSOFT CASHBACK.

Sharing data with merchants, payment card networks and third parties – card-linked offers

Your participation in the card-linked offers program is subject to the Microsoft Privacy Statement.  In addition to the purposes described in the Microsoft Privacy Statement and as described in these Terms, when you participate in the card-linked offers program, Microsoft and Figg Inc. (“Figg”) will use transaction information as follows:

  • Use transaction data to confirm a qualifying purchase or return to match transactions to confirm whether you qualify for a statement credit or an offer;
  • Share transaction data with the participating merchant where a transaction occurred as needed for the merchant to confirm a specific transaction occurred or points should be awarded; for example, the date and amount of your purchase and the last 4 digits of your card number so the merchant can verify your purchase with its records if there is a missing or disputed transaction;
  • Provide participating merchants aggregated and anonymized information relating specifically to registered card activity solely to allow participating merchants to assess the results of their campaign;
  • Create a record of the transaction data and thereafter maintain and use data in connection with operating the card-linked offers program (including customer support and fraud analysis);
  • Target offers that may be of interest to you and enable further personalized offers based on your purchase history;
  • Conduct analysis for the improvement and optimization of the card-linked offers program; and
  • Provide information in order to respond to a request from government authority or a payment organization involved in a transaction with you or a merchant.

BY PARTICIPATING IN THE MICROSOFT CASHBACK PROGRAM, YOU AUTHORIZE THE SHARING, EXCHANGE AND USE OF TRANSACTION DATA DESCRIBED ABOVE AND HEREIN BY AND AMONG MICROSOFT, FIGG, APPLICABLE PAYMENT CARD NETWORKS AND APPLICABLE MERCHANTS. YOU MAY OPT OUT OF THE SHARING OF SUCH INFORMATION BY REMOVING YOUR LINKED CREDIT OR DEBIT CARD FROM YOUR ACCOUNT AND BY DOING SO YOU WILL NO LONGER BE ELIGIBLE TO RECEIVE CASHBACK FOR IN-STORE PURCHASES.

Location based card-linked offers

You may receive relevant card-linked offers or notices through the web, the Bing app or Bing Maps based on your location (if you have location services turned on and have granted permissions for the application to use your location information). To stop receiving card-linked offers based on your location, you can turn off location services on your device or turn off the particular application’s access to location services.

Liability exclusion and indemnification for Payment Card Networks

For the avoidance of doubt, to the maximum extent permitted by applicable law, the warranty disclaimer and limitation of liability set forth in Sections 12 and 13 of the Microsoft Services Agreement include Payment Card Networks and the third party service providers who support the card-linked offers program.

YOU AGREE TO INDEMNIFY AND HOLD FIGG, THE PAYMENT CARD NETWORKS AND EACH OF THEIR PARENTS, SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS AND EMPLOYEES HARMLESS FROM ANY CLAIM OR DEMAND, INCLUDING REASONABLE ATTORNEY'S FEES, MADE BY ANY PARTY DUE TO OR ARISING OUT OF YOUR PARTICIPATION IN THE MICROSOFT CASHBACK PROGRAM.

Changes to Terms and Microsoft Cashback program

If you are a consumer resident in the UK or the EU, we may regularly make updates and changes to the Service/Terms, including in the following circumstances (and without any cost to you): (i) to ensure compliance with applicable laws and/or reflect changes in relevant laws and regulatory requirements, such as mandatory consumer laws; (ii) to perform temporary maintenance, fix bugs, implement technical adjustments, for operational purposes or make improvements; (iii) to upgrade or amend the Services including amending or making modifications to existing features and functionality; (iv) to alter the structure, design or layout of the Services, including amending, improving and/or expanding the features of the program; (v) for security reasons.

If we make any changes to the terms as specified above and we reasonably consider such changes will materially negatively impact your access to or use of the Services, we will give you at least 30 days’ notice of the changes. If you do not close your Microsoft Account and/or opt-out of Microsoft Rewards following this timeframe, we will take that as acceptance of the changes.

Changes to Terms

If you are a consumer resident in the UK or the EU, we have the right to change these Terms at any time for the following reasons: (i) to improve the Terms, including to make the Terms easier or clearer to understand or to have all our customers on the same Terms; (ii) to comply with legal or regulatory requirements such as mandatory laws that apply to us and our agreement with you or where we are subject to a court order or judgment; (iii) to provide you with additional information about the Service; (iv) where we make changes to the Services, including the structure of the Service and/or to expand the scope of the Service by adding additional features; (v) where we reorganise the way we run our business, including merging with another brand or service; or (vi) for security reasons, including where we introduce additional security checks to protect our Services; (vii) for any other reason, provided such changes to our Terms are reasonable.

If you are a consumer resident in the UK or the EU and we reasonably consider that any changes to these Terms will negatively impact your legal rights or obligations in a significant way, we will provide you with at least 30 days' notice of these changes. If you do not close your Microsoft Account and/or opt-out of Microsoft Rewards following this timeframe, we will take that as acceptance of the changes.

For all other consumers, we may change these Terms at any time, and we’ll put a notice on the Microsoft Cashback dashboard when the Terms are updated. Participating in Microsoft Cashback after the changes become effective means you agree to the new Terms. If you don't agree to the new Terms, you must stop participating in Microsoft Cashback and transfer any earned cashback to PayPal. 

Termination

WE MAY TERMINATE THE MICROSOFT CASHBACK PROGRAM AT ANY TIME PROVIDED THAT WE GIVE YOU REASONABLE NOTICE IN ADVANCE.

FOR ALL CONSUMERS, IF WE TERMINATE THE PROGRAM, YOU WILL HAVE A REASONABLE  OPPORTUNITY TO TRANSFER EARNED CASHBACK TO PAYPAL, BUT YOU WILL NOT BE ABLE TO EARN ANY ADDITIONAL. 

You can opt-out from the Microsoft Cashback program at any time by closing your Microsoft account or opting-out from Microsoft Rewards. If you choose to close your Microsoft account or opt-out from Microsoft Rewards, you will be unable to access your Microsoft Cashback dashboard nor transfer any cashback amount to your PayPal account. You should therefore ensure that you have transferred any remaining Microsoft Cashback balance prior to opting-out of Microsoft Rewards or closing your Microsoft account.

If we terminate the program and a merchant has not yet reported to us that your purchase is eligible for a cashback, we have no obligation to pay such cashback.  We may, in our sole discretion (or, for consumers resident in the EU or UK, our reasonable discretion), pay you the cashback if you provide us with sufficient evidence establishing that you made the purchase and would have earned a cashback had the program continued.
